A Real Divide Between the Law and Ethics Essay Example | Topics and Well Written Essays - 1250 words
A Real Divide Between the Law and Ethics - Essay Example Excellence morals doesn't generally give obvious models to the rightness or misleading quality of a demonstration in any case, it can disclose to you whether the individual is fortunate or unfortunate relying upon social appearances. In addition, goodness morals doesn't address the issue of relativism â⬠one great quality may not be considered as acceptable in another culture. Another hypothesis is utilitarianism. In this hypothesis, the rightness or unsoundness of the demonstration is reliant on the involved results of the demonstration (Velasquez, 2006). On the off chance that there will be numerous recipients from the demonstration, at that point the demonstration is acceptable. As it were, on the off chance that the demonstration will satisfy more individuals, at that point the demonstration is acceptable. In this sense, as the emphasis is turned on the outcome of the demonstration, checking what number of will be more joyful or what number of will profit by the demonstration turns into the boundary for the rightness or unsoundness of the demonstration. This hypothesis is condemned in light of the fact that it is unclear with respect to what is bliss and how glad will be estimated. Besides, the topic of relativism and the peril of the deception of the dominant part become an innate worry of this hypothesis. Obligation based morals is the last hypothesis that will be quickly talked about. As indicated by this hypothesis, rightness or unsoundness of the demonstration doesn't rely upon its outcome, rather, rightness or misleading quality is natural in the demonstration itself. All things considered, there are acts that one should do and acts which one should not to do. This hypothesis gives a clear order on what should be finished. This is on the grounds that the hypothesis lays on the presumption that every single individual are a sound human operator and as reasonable specialists, they will do the correct demonstration and evade an inappropriate one.

Following a year in the Army, Revere got back to Boston, assumed control over the family silver shop, and wedded his first spouse, Sarah Orne. In the same way as other skilled worker of the period, Revere required some supplemental salary, so he took up the act of dentistry. Rather, Gage decided to concentrate his composed requests on claiming the weapons he accepted to be housed in Concord. Over the coming days, Revere trained the sexton at the North Church to utilize a sign light in the steeple in the event that he saw British warriors drawing closer. Since the British could either take the street from Boston to Lexington or sail up the Charles River, the sexton was advised to light a solitary lamp for land development, and two if there was movement on the water. In this manner, the expression one if via land, two if via ocean was conceived. On April 18, Warren revealed to Revere that reports demonstrated that British soldiers were furtively moving towards Concord and the neighboring town of Lexington, apparently to catch Adams and Hancock. In spite of the fact that the weapons gracefully had been securely moved, Hancock and Adams were ignorant of the approaching peril. At the point when the sexton at the North Church set two lights in his steeple, Revere moved energetically. He crossed the Charles River in a skiff in the dead of night, cautious to maintain a strategic distance from the notification of the British warship HMS Somerset, and arrived in Charlestown. Adore showed up in Lexington around 12 PM, and cautioned Adams and Hancock, and afterward headed towards Concord. On his way, he was halted by a British watch and addressed; he told the fighters that in the event that they moved toward Lexington they would get themselves eye to eye with a furious and equipped state army. Eventually, when they approached Lexington with Revere close behind, the towns church ringer started to ring; Revere disclosed to them it was an invitation to battle, and the warriors left him in the forested areas to walk the remainder of the best approach to town alone. When he showed up, he got together with Hancock, and helped him get together his family so they could escape securely as the fight on Lexington Green started. During the Revolutionary War, Revere couldn't come back to Boston, yet remained in Watertown, where he proceeded with his work as a dispatch for the commonplace congress, and printed money for installment of the nearby state armies. Dr. Warren was killed at the Battle of Bunker Hill, and nine months after his demise, Revere had the option to distinguish his remaining parts, unearthed from a mass grave, on account of a bogus tooth he had mounted for his companion, making Paul Revere the main criminological dental specialist. There is no proof that Revere really yelled out The British are coming! during his renowned ride. Later Years After the Revolution, Revere extended his silversmithing business and opened an iron foundry in Boston. His business delivered give iron merchandise such a role as nails, loads, and apparatuses. Since he was happy to put cash into growing his foundry, and grasped new mechanical thoughts in the field of metalworking, he turned out to be exceptionally fruitful. In the long run, his foundry moved into iron and bronze throwing, and he had the option to mass produce church chimes as America moved into a post-war strict restoration. With two of his children, Paul Jr. what's more, Joseph Warren Revere, he established Paul Revere and Sons, and slowly idealized the creation of moved copper. Dewey's Democratic Individualism - Essay Example Indeed, even wrongdoing is getting corporate. What happens these days is that these companies [effect] a difference in public activity from a person to corporate issue. Reactions of the individual and society all in all to this change are complex: they influence the mental, proficient, and political circle. As indicated by Dewey, they influence the working thoughts, convictions and direct of us all. Anyway there is a part inside individual and in a general public, and most explicitly the split inside the new business mind. The split comes about in light of the fact that the consequences of industry.. are corporate and aggregate while the internal intentions are private and person. Dewey calls goals to this express a law of mental respectability; this will come about when internal thought processes become worried about corporate objectives that is to state, shared objectives. Dewey says: When the corporateness gets inner, that is, it is acknowledged in thought and reason, it will become subjective Law will be acknowledged not generally speaking self-assertively forced from without yet as the relations which hold people together. According to Dewey, these two articulations are firmly associated with fundamental inquiry relating to uniqueness: the requirement for another hypothesis and new ethics which would clarify human instinct and its association with society in these new monetary conditions. This would be the premise of popular government in current American culture. Dewey expresses that Dewey expresses that [a]ssured and incorporated distinction is the result of positive social connections and openly recognized capacities. These connections being set up, just as the open affirmation of the job of various human undertakings inside a present society, the split of the business brain would be mended. There should be some accord of conviction concerning the significance of account and industry in human progress in general. This would flexibly a feeling of significance to the business brain and its significance inside a general public. Dewey further dissects this social and individual split. What is missing as a prize for accomplishing one's parts of the bargains, (being budgetary benefit), is a feeling of social satisfaction. Is There An Enforceable Contract Between Samantha And Julie - 1375 Words
Is There An Enforceable Contract Between Samantha And Julie? (Case Study Sample) Content: Common Law AssignmentUniversitys Name:Submitted by:Tutor:27th August, 2016Word Count: 1,425Issue: Is There An Enforceable Contract Between Samantha And Julie?Case Law and ApplicationYes there is an enforceable contract between Samantha and Julie. As is the case with Carlill v Carbolic Smoke Ball Co, the nature of the transaction between Samantha and Julie contains all the elements of a contract. First of all, there was an offer to contract given out by Samantha when she asked Julie whether she would prepare cakes and sandwiches for consumption for the one hundred people who will attend the comedy play. Additionally, there was an acceptance when Julie said that she would indeed prepare the cakes and sandwiches for the event. By accepting the offer given by Samantha, Julie agreed to be part of the contract.[Carill Versus Carbolic Smoke Ball Co [1893]1 QB 256] There was also a consideration involved in the transaction when Julie says that she will charge $5 per person an d so the total will be $500. Owing to the fact that Samantha did not refute the proposed price, this stands to be the consideration for this contract. There is also a mutuality of obligation and a willingness to be legally bound. Both Samantha and Julie understand the roles they have to play in the transaction. While Julie is supposed to prepare cakes and sandwiches for consumption by the play attendees, Samantha is supposed to provide remuneration for this, as well as giving further instructions to Julie.Further, the transaction has another element of a contract which is the competency and capacity to contract. Julie has a sound mind and has an understanding of what role she has to play in the transaction even though she is a minor. She also stands to gain financially from this contract and so this contract is enforceable. However, Julie would not be held liable for a breach of the contract if she failed to perform her part of the contract because the law considers minors to be too young and inexperienced to negotiate for favorable contract terms with adults. On the other hand, Samantha is a sane adult, capable of making decisions and entering into contracts and thus she has the capacity and competency to contract. Finally, the transaction between Samantha and Julie is an enforceable contract because there is a written agreement to show it. This is in the form of a text message that Samantha sent to Julies phone, asking her to proceed with the preparation for cakes and sandwiches.ConclusionThe transaction between Samantha and Julie contains all the elements of a contract and it is therefore legally binding.Issue: Assuming There Is an Enforceable Contract between Julie and Samantha, Does Samantha Need to pay $100 To Julies Mother Martha?Even though there is an enforceable contract between Julie and Samantha, Samantha does not need to pay Julies mother Martha, for the ingredients used by her daughter to prepare the sandwiches and cakes; neither does she have to deduct the same amount from the consideration to be given to Julie. This is because Samantha entered into a contract with Julie and not Martha. In this contract, Martha is a third party.Case Law and ApplicationAccording to the case law Trident General Insurance Co Ltd v McNiece Bros Pty Ltd that forms the basis of the doctrine of privity, only the parties that have entered into a contract are bound by it and a third party not privy to the contract has no legal capacity to enforce it. Samantha is therefore not under any legal obligation to pay Martha.[Trident General Insurance Co Ltd v McNiece Bros Pty Ltd [1988] 165 CLR 107] ConclusionEven if Martha sought legal action, the court will not award any compensation to her as this will be in breach of the contractual law, binding the willing parties. Instead, Julie on her own should be the one responsible for paying her mother for using her ingredients to prepare the cakes and sandwiches for which she was contracted. However, this will be a different agreement all together that Samantha will not be a part of; since the agreement between her and Julie did not involve a discussion on the sourcing of ingredients for the preparation of cakes and sandwiches. Her interest was in the finished productIssue: Is Promissory Estoppel Relevant to Samanthas Dispute with Dave from Outrageous Costumes?Promissory Estoppel refers to the legal principal which states that a promise is enforceable by the law even though a formal consideration was not made when a promisor made a promise to a promisee who then relies on that promise to his subsequent detrimentà (Lambiris, Michael and Griffin Laura, 2016).[Lambiris, Michael and Griffin, Laura. The first principles of business law. Australia. 2016.Pp.61-101] Case Law and ApplicationThis principle is relevant to Samanthas dispute with Dave from Outrageous Costumes. The scenario is similar to the case of Waltons Stores Ltd v Maher in which Walton sought lease of a property owned by Mah er. The parties agreed that the initial building would be demolished and a new one would be erected and this new building would be occupied by the Waltons. Rent agreements were even drawn. However in the course of the process, Waltons started having second thoughts about the project. They did not therefore complete the lease agreements. Waltons did not communicate this to Maher even after they had been informed that demolition was underway. Waltons only communicated that it did not wish to continue with the agreement while 40% of the new building was already underway. When Maher sought legal action to enforce the promise, the judge ruled that Waltons was liable to avoid the detriment to be incurred by Maher if the promise is not followed through with.[Waltons Stores Ltd v Maher (1988) 164 CLR 387] This is because Samantha contacted Dave via email for the creation of the Smurf space suits and even told Dave to go ahead and procure the s...

Business Plan Engineering and Business Education
Question: Discuss about theBusiness Plan for Engineering and Business Education. Answer: Introduction Marketing is such a concept that has become the common phenomenon in the business world. But, marketing in the contemporary industrial era has changed a lot due to the increasing competition and the level of consumers need or desire (Cranmer, 2015). Here, based on the instances of successful business model and philosophy, an introduction of a new brand would be performed in this study. Hence, depending on the different aspects of the collaborative consumption markets and the customer to business philosophy exercised by Jack Ma, CEO and self-founder of Alibaba.Com, the researcher intends to present a new brand set up by implementing business models in this regard (Barnes and Mattsson, 2016). Hence, a detailed analysis of the target segment would be provided along with the strategies that would be able to attract the customers or the target segment. Hence, in the succeeding components a start-up business plan would be carried out along with the fact that would be influencing the custom ers needs. On the other hand, a detailed description of the marketing campaign would be evaluated by the researcher in order to deliver insight regarding the ways how the new product would be able to attract customers. What is the Idea? In this report, the researcher has inculcated the idea to develop a new business plan that would be able to deliver the idea of setting up a new brand. Here, a new brand named as GoInstant has been introduced in the field of taxi services that are aided with technology. The main objective of this report is to identify the target market and analyses the need of consumers in the context of fulfilling the requirement of the modern society. In this regard, it can be asserted that a new brand could be launched that will be different from other app based taxi services (Dezhi and Wenjing, 2014). This brand would be targeting the corporate consumers along with the general consumers. The corporate customers include, the organizations acting in the field of IT sector, retail or aviation industry. In accordance with Ma business philosophy, in the context of customer to business venture the brand would be concentrating on the customer satisfaction and services provided to them. As per the philos ophy preached by jack ma, organizations need to place customers first and employees and other stakeholders in the succeeding place in order to gain success in the organizational competition. Hence, the brand would be adopting effective marketing strategies that would be developed in the context of the target market and generate new ways to reach to the end user customers or the service customers with their marketing strategies, which would deliver success to the brand in the market (Espndola, 2002). Therefore, in order to ensure the fact that the new brand or product would get prominent in the market through the exceptional services or strategies of the product, certain ways of campaigning could be discussed in details. Description of the Target Market In this report, the researcher has determined the corporate consumers and the general customers as the target market of the service provider. The corporate customers is apt in this regard as most of the IT or aviation industries providing a pool car system or taxi fares to the employees as a beneficial service by the organization. Hence, the brand could concentrate on the providing exceptional technological services to the customers. According to the customer to business venture, the philosophy delivered by Jack Ma asserts that if the employees of the respective brand or organization would invest in acquiring the good faith of the boss, then the business would never be able to obtain success in the market, instead the employees should concentrate on satisfying the customers then only the success could be attended in this regard (Greenbank, 2000). On the other hand, the business models like product service system, redistribution of market and collaborative lifestyle would also effects the success factors of the brand. Hence, the researcher has opted for Australian market and targeted the Australian corporate and general customers in for the promotion and success of the respective brand. The Australian corporate sector has adopted the transportation services for the employees which is not a new strategy of the organizations, rather previously it has been observed that organisations have provided services like this to the employees. Therefore, the act of launching this new transportation service in Australia will provide customers individual attention as the movement of the customer would be recorded through satellite data transcription that would be able to locate the position of the customer before and after availing the taxi or pool car services. Another exceptional service that has been incorporated by this new brand would be safety measures of the customers who are travelling at night. This would be beneficial especially for female customers working in the IT or in the aviation industry. The brand would provide or avail a safety measure app in each of its taxies, so that the safety would be ensured by the organization directly. Therefore, through these strategies or services that have been included in the transportation system would be expected to draw attention of the Australian consumers and the benefit of investing in such brands could be depicted in terms of the modern technology that has made people go for an of the easiest option with loads of benefit. Here the customers would get benefited through instant service along with the assurance of both quality service and experience in this regard. It has been also inculcated that a monthly or quarterly feedback call could be made to the customers in order to obtain knowled ge regarding the services and other aspects in this regard. Therefore, these benefits would be expected to draw more customers for the brand in the succeeding future (Principles published for NICE Implementation Collaborative, 2013). Approach to End Users of the Service In the context of depicting another section of target market that would be the end users of the service, it could be cited that the general customers could be identified as the end users of the service providers. It is an evident fact that general customers are the ones that would ultimately utilize the proposed services of the brand. In the context of Australia, it can be cited that most of the consumers of taxi services uses taxies as the common medium of their transportation. In order to provide an in depth analysis of the fact it could be referred instead of an affluent country that is have enough financial resources, most of the people in the contemporary modern society would opt for those services that would be cheap as well. Therefore, it can be assumed that people will prefer the intended brand in the Australian market in relation to end users as this product would be providing quality services in cheap price. Instances could be provided in terms of the Australian app based t axi service that has gained a remarkable profit while beating the rivals like Uber in the market with its cheap rides. In the same way it can be expected that the intended brand would be able to set its foot in the Australian market. In this context this approach, the essential business models that have helped organizations to gain sustainability in the market could be assessed and linked with the purpose of this study in a critical way. At the first place, the product service system could be analysed here in terms of the customers that are coming from different background with a common mind-set that includes the act of paying for any services that delivers benefit to them this could be terms as product service system (Strmbck, 2007). In the context of generating a new brand in Australia, it could be said that this model has an evident impact on its future market strategies which can be depicted through the common reaction of the end users in this regard. On the other hand, in relation to redistribution market it can be said that, it delivers the idea of reusing the old ones and defeated the traditional myth regarding buying new and buying fresh, therefore, in the context of the proposed brand it could be linked with the model that is included in the collaborative consumption through the idea to reuse the old strategies while, incorporating several new ones. Finally the collaborative lifestyle depicts the fact that, people are not only sharing the materialistic goods but also their valuable energy, time and interest. Hence, it could be depicted that the proposed business plan that is intended for the Australian customer are also sharing their time, skills and energy with the customers to provide best quality service to them (What's mine is yours: the rise of collaborative consumption, 2011). In order to depict the beneficial aspects for the end users of this service it can be said that the taxi service provider would deliver ample amount of benefit to the customers in terms of providing consumers from different financial background the affordable medium of transportation in an age while economic collapses takes place. According to Ma philosophy, customers holds the leading position in an organizational structure while it is the question of customer satisfaction. Through customer satisfaction organizations would be able to acquire success and sustainability at the same time in an era of tough competition. Therefore, it is recommended for the organization to concentrate on the promotional activities and other marketing strategies in order to gain success in this regard (What's mine is yours: the rise of collaborative consumption, 2011). Four Principles of Collaborative Consumption In this report the four collaborative consumption principles would be evaluated in relation to resolve the issues, that are related to the idea of setting up a new brand in the Australian market. Hence, at the first place, the issues related to the critical mass that can be defined as one of the most important ingredients in the context of collaborative consumption that includes a group of loyal and frequent users of a product in the market.in the case of GoInstant that the researcher has intended to launch in the Australian market, it can be said that first it need to build a critical mass that strives for the environmental security. Hence, GoInstant would effectively generate natural gas based fuel for the cars so that the quality services would be delivered for to the customers while maintain the environmental securities at the same time (Laamanen et al. 2015). On the other hand, the second principle in the context of collaborative consumption can be discussed in terms of power idling capacity that is in general sense could be considered as a waste of something that is not in use. Therefore, if it can be considered as the power consumption or waste of resources which could be reduced as proposed by the strategic management of GoInstant, that is it would concentrate on reducing the power consumption in generating the steatite data transcription process through the implementation of some software that are able to perform the task in this regard. Another important fact in this regard, is the assessment of the third principle that is belief in the commons which could be described as the common this that is assigned for everyone. In the roman belief that were divided in two segmentations of the same thing that is one places or things that are not intended for every one that is park, roads and other public places . On the other hand, they also belief the principle of things for commons, that is the allowed and delivered for everyone like, air water, land and soon. In the context of GoInstant it can be said that thee brand would maintain all the aspect that is required to fulfil customer satisfaction. The services that the organization intends to provide to the customers mostly depend on the third principle of collaborative consumption as it has been assigned for the convenience and betterment of the common people within the Australian market (Strmbck, 2007). Lastly the fourth principle that can be terms as the trust between strangers that is individuals or organization and the customers or other part of human society have the power to assess each other. According to this principle individuals and brand are able to detect the deficiencies in each other through complete assessment of each other (Strmbck, 2007). Hence, such situation in the context of go instant it can be realized that the organization needs to acquire the current market demands and the customers need at the first place as in near future it has been customers will be dominating he business industry. Therefore, the respective organization would be conducting an introduction launch plan for the Australian customer to get informed reading the new app based taxi services along with the opportunity to study the customers perception in this regards and vice versa (Laamanen et al. 2015). Therefore, it is quite natural that GoInstant would be performing in the intended market segment with all the aspect keeping in mind so that the social factors would not be hampered along with keeping the business or service facts in line. 7 Writing Warm Ups for More Productive Writing
7 Writing Warm Ups for More Productive Writing Wonder how to stimulate and encourage your brain to simply dive into the writing process? A few warm-up activities will help to get your words and ideas flowing. Why is it important to warm up? The answer is quite predictable: to avoid the writers block and start writing right away. You would be surprised at how much writing will come from you once youre warmed up. Youll easily banish all distractions and get down to putting the words on paper. Here are a few proven ways to make you think and force your brains into action. 1. Describe Whats Going On Outside Your Window It is the easiest writing warm up ever! You just to have look out your window and write down your observations. Try not just to focus on people, buildings and weather, think what else is there. Do you see something unusual? Consider the peoples emotions and imagine what they may be talking about. Try to be specific to make sure that your description takes no more than 5 sentences. Its just a short warm up that shouldnt last more than 15 minutes. 2. Write Imaginary Definitions of Unknown Words Take a dictionary and open it on a random page. Find a word you are not sure how to define. Then create an imaginary definition for it. Play with words and youll discover new ways of saying old things. Be inspired and your imagination will help you produce the most vivid descriptions. Repeat this exercise for several times until you feel that your brain is warmed up enough to proceed with your main task. 3. Describe Your First Experience Describe your first. Your first day of school, first kitten, first job, first car, first yoga class, first date, it doesnt matter ââ¬â all will make excellent stories. The first time of doing something is always an exciting experience, so youll easily find the right words to describe it and avoid that situation of staring at a blank sheet of paper. Concentrate on your emotions and start developing them in full ââ¬â get the creative juices flowing! 4. Pretend Youre a Travel Writer Find a world map and blindly put your finger somewhere. Then pretend you are a travel writer and tell about the weird experience in that particular country. What happened? How did you behave in that unusual situation? How did you solve the problem? You may include anyone and anything you want into your story ââ¬â locals, taxi drivers, bartenders, random people. Youll get a killer piece of content, just take some inspiration and put your pen to paper. 5. Create a Half-Page Monologue Creating monologues is a great way to warm up, so get in the habit of writing them. Take a newspaper or go to google news, find an interesting headline, then decide on a character who comes from that headline and write a short monologue for that character. Be specific, it is just a warm up and you dont have to create a long piece of writing. A half-page monologue will be more than enough to get your brain into the writing mode. 6. Write a Letter to Your Future Self Writing a letter can be a really wonderful experience. There are no restrictions on how old you should be ââ¬â one year, five years or 10 years from now. What would you say? What kind of person would you be? What goals would you want to have achieved? Think about your place in life, your achievements or fails. First of all, identify the period of time to write about and start writing. Dont pay much attention to the letter format as its just a quick warm up. 7. Consider a Free Writing Session Give yourself a time limit and go. Dont stop, just get the words on a page. Write about everything that comes to your mind. Dont give your brain a moment to stop or evaluate your ideas, set a timer for 10 or 15 minutes and write without interruption. Free writing is not the time for editing or judging, you need to keep your pen moving. You will see that a free writing session is beneficial for more productive writing.
